Montana Unclaimed Property

How did the state government come into picture? The financial institutions – Banks, AMC and security deposit institutions will hold your account proceeds only till the dormancy period expires. After this period the account deposits and details are passed on to the state government of Montana. Dormancy period is for five years in state of Montana and if account holder does not transacts for this period the account becomes unclaimed.

Unclaimed property and name of the people to whom state owes can be found online. This can either be checked through state government’s website or NAUPA’s website. The process for filing and recovery for an unclaimed asset is for free. It is the responsibility of the state treasurer to ensure that rightful owners are united with their unclaimed property and the money is released as per legal guidelines in place.

As a holder of property, should report to the state government of Montana if the unclaimed property is worth $50 or more. Between 60-120 days before filing the claim the holder is required to notify owners of their intention for declaring their pending property as unclaimed. In case they do not receive any communication or action from the owner’s end the property eventually becomes unclaimed and state government of Montana becomes the custodian of the unclaimed property. Rightful owner or his/her legal heir can file for claim anytime and recover the property from state’s custody.

The department will not charge any service fee from the claimants only in absence of a valid contract between the holder and the owner. A claimant can claim for more than once in a year too. While doing so claimants are required to mention their report number in e-file or line 4 of the paper report.
